Understanding the Client-Attorney Relationship

If you are engaged in a legal battle of any kind, it’s important to understand that the outcome can color your perception of the attorney who fought on your behalf. A victory that returns significant compensation will undoubtedly paint your lawyer as a hero, whereas a financial loss can cast a very negative light on your legal representative. So, if your case did not reach the conclusion you wanted, it does not necessarily mean that you have grounds for legal malpractice.

However, less than stellar service can impact the outcome of your personal injury claim as well, so it is crucial to have a clear idea of what to expect from the client-attorney relationship from the very beginning. You have chosen to entrust your faith and confidence in your lawyer’s abilities regarding your case; in return, you should expect the following:

Duty of Confidentiality: All confidential that you discuss with your attorney should be kept between you and your attorney, unless you give permission to share it or another exception applies. This will allow you to talk truthfully and provide as much information as possible that may help your case.

Diligent Representation: Your attorney should diligently represent you (as long as it is not illegal or fraudulent) and keep you informed of the status of your case on a regular basis. This includes thorough preparation, open communication, and providing the information you need to make the best choices for your case.

Avoid Conflicts of Interest: As your legal representative, your attorney may have to turn down work that might conflict with your best interests. For example, a lawyer would not represent both sides in a domestic violence case because he or she might have access to information that would interfere with his or her ability to protect both clients’ best interests.

Competent Representation: Your lawyer should be honest and upfront about his or her ability to handle your case. Even the most experienced attorney may need a reasonable amount of time to investigate and build a strong case on your behalf; however, if the matter is too complex or outside of his or her expertise, you have a right to know in order to make an informed decision about your case.
